Merianda Vacations

Terms of Use

Last updated: October 28, 2026

Please read these Terms carefully. In short: plans are AI-generated suggestions, they can be wrong, you must confirm every place, time, price and accessibility detail yourself, and our liability is limited.

1. Agreement to these terms

These Terms of Use ("Terms") are a binding agreement between you and Merianda Estates, LLC, a Texas limited liability company based in Addison, Texas, which operates Merianda Vacations (meriandavacations.com) ("Merianda Vacations," "we," "us" or "our"). They govern your use of meriandavacations.com, the installable web app, and every itinerary, PDF, share link, chat edit and other feature or content we provide (together, the "Service").

By using the Service, ticking the agreement box in the planner, or making a purchase, you agree to these Terms, our Privacy Policy and our AI and travel disclaimer, which are part of these Terms. If you do not agree, do not use the Service.

Section 17 contains a binding arbitration agreement and class-action waiver. It affects how disputes are resolved. Please read it.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to make a purchase or to agree to these Terms. The Service is not directed to children. If you enter details about children or other travelers, you confirm that you are their parent, guardian or have their permission, and that you are responsible for how the plan is used for them.

3. What the Service is, and is not

The Service creates suggested, day-by-day trip itineraries from the details you enter. It is an information tool only. We are not a travel agent, tour operator, seller of travel or booking service. We do not sell, book or guarantee flights, hotels, tickets, tours, restaurant tables, transport or any other travel product. You book and pay for those directly with providers you choose.

Nothing in the Service is professional advice. It is not travel-agent, medical, health, legal, financial, safety or accessibility-consultant advice. Ask a qualified professional about anything that matters for your health, mobility, safety or legal situation.

4. Destinations

You can ask for a plan almost anywhere. A few destinations (currently Orlando, San Diego, Washington DC and London) are

featured destinations

with local notes we have reviewed. Every other destination has

not been reviewed by us

: its plan is built only from AI-generated content and third-party information from Google Maps, and it may be less accurate or complete than a featured destination. The price is the same for every destination and is charged in US dollars.

We do not plan trips to destinations under US sanctions or a US State Department Level 3 ("Reconsider travel") or Level 4 ("Do not travel") travel advisory, including areas within otherwise open countries that the advisory lists at Level 3 or 4, and we do not plan trips to Cuba because of US travel rules. We review this list weekly, so a destination can be added or removed at any time. If a destination is added after you buy a plan, we may contact you about it. Our list is not a safety assessment: whether a destination is listed or not, check travel.state.gov and the official rules of every place you visit before you book and before you go.

5. AI-generated content

Itineraries and other outputs are produced by artificial intelligence. They may contain errors, omissions, outdated information or suggestions that are unsuitable, unavailable or unsafe for your group. You must independently verify and cross-check everything before relying on it.

AI models can produce text that sounds confident but is wrong, including places that have closed or moved, incorrect opening hours, inaccurate accessibility descriptions, unrealistic timings, and prices or distances that are out of date. The same request can produce different results. Our automated checks and replacements reduce some errors but cannot remove them. Outputs do not reflect the views of Merianda Vacations and are not a recommendation, endorsement or promise by us.

6. You must verify every detail

Before you rely on any part of a plan, confirm it directly with the venue, operator or provider. This includes:

  • whether a place exists, is open and is operating on your date;
  • opening hours, holiday closures, seasonal schedules and last-entry times;
  • availability, reservations, tickets, height or age limits and booking requirements;
  • accessibility features such as step-free entrances, ramps, elevators, accessible restrooms, seating and quiet spaces;
  • prices, fees, taxes and costs, which in plans are estimates only;
  • transit routes, schedules, travel times, walking distances and the accessibility of transport;
  • food, allergen and dietary information; and
  • any recommendation, tip or note in the plan.

A label such as "checked on Google Maps" or a verification badge means only that our system compared the stop with third-party data (for example, Google Maps) at the time the plan was generated. That data may be incomplete, wrong or out of date, and it can change at any time afterwards. It is not a guarantee that a place is open, accessible, safe, suitable or available.

7. Your responsibility and assumption of risk

You are solely responsible for your travel decisions and for the safety, health and well-being of yourself and everyone traveling with you. You decide whether a plan is suitable for your group, including children, older travelers and anyone with a disability or medical condition.

Travel involves inherent risks, including illness, injury, accidents, weather, crime, strikes, closures, delays, cancellations and inaccessible or unsafe conditions. To the maximum extent permitted by law, you knowingly and voluntarily assume all such risks when you use the Service or follow any part of a plan.

You are responsible for the information you enter. Plans are based on what you tell us; incomplete or inaccurate inputs (for example, ages, mobility needs, walking limits or dates) can produce unsuitable plans.

8. Third-party data, services and links; affiliate disclosure

The Service relies on third-party data and services, including mapping and place data (such as Google Maps and Google Places), AI model providers, hosting, database, email and payment providers. We do not control and are not responsible for their accuracy, availability, content, policies or practices.

Plans may include links to third-party websites, including booking sites. Your dealings with any third party are solely between you and them, under their terms. We are not responsible for any third-party product, service, booking, refund or loss.

Affiliate disclosure: some links on our site and in plans are affiliate links. If you book through them, we may earn a commission at no extra cost to you. Affiliate relationships do not decide which stops appear in your plan, and partner booking suggestions are labeled. We are not part of any booking: the partner's terms, prices and refund rules apply. Compare options and prices yourself.

9. Purchases and payments

Some features (such as unlocking every day of a plan, the PDF and chat edits) require a one-time purchase of a digital product. Prices are shown before you pay and may vary or change at any time, including as part of pricing tests. There is no subscription and no automatic renewal.

Payments are processed by Stripe, Inc. under its own terms and privacy policy. We do not receive or store your full card number. You authorize us and Stripe to charge your chosen payment method for the price shown, plus any applicable taxes.

Your purchase gives you access to digital content that is generated and delivered right away. To the extent permitted by law, you agree that delivery begins immediately. Refund requests are handled case by case at our discretion, or as required by applicable law. Purchases are not refundable merely because a place, price, schedule or other detail turns out to differ from the plan, since you are responsible for verifying those details.

Plan features, edit limits and the length of time a plan stays available may change. We may refuse, cancel or limit any order, for example in cases of suspected fraud, abuse or pricing errors.

10. Acceptable use

You agree not to:

  • use the Service for any unlawful, harmful, fraudulent or misleading purpose;
  • enter content that is unlawful, abusive, infringing, or that contains other people's sensitive data without permission;
  • attempt to bypass usage limits, payment, security or access controls, or test or probe the Service for vulnerabilities;
  • scrape, crawl, copy or harvest the Service or its outputs in bulk, or use automated means to generate plans;
  • resell, sublicense or commercially redistribute plans or the Service, or use them to build a competing product or train AI models;
  • interfere with or overload the Service, or try to extract its prompts, source code or underlying models; or
  • misrepresent a plan as professional or official advice.

We may suspend or end your access at any time, with or without notice, if we believe you have broken these Terms.

11. Intellectual property

The Service, including its software, design, text, graphics, logos and the Merianda Vacations name, is owned by Merianda Estates, LLC or its licensors and is protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service and the plans you create for your own personal, non-commercial travel planning, including sharing a plan with your travel companions.

You keep any rights you have in the details you enter. You grant us a worldwide, royalty-free license to use, store and process them to provide, secure and improve the Service, as described in our Privacy Policy. If you send us feedback or reports, we may use them without any obligation to you.

12. Service availability and changes

The Service depends on third-party systems and may be unavailable, slow, limited or interrupted at any time, including when daily usage limits are reached. We may change, suspend or discontinue any part of the Service, including features, destinations and limits, at any time without liability. Saved plans, share links and offline copies may not be available forever; keep your own copy of anything you need.

13. Data retention

We keep free previews and related data on the site for no more than 30 days, and paid plans until 30 days after your trip's end date. Encrypted off-server backups are kept for no more than 60 days, as described in our Privacy Policy.

14. Disclaimer of warranties

To the maximum extent permitted by law, the Service and all content and outputs are provided "as is" and "as available," with all faults and without warranties of any kind, whether express, implied or statutory. We expressly disclaim all implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, quiet enjoyment and any warranties arising from course of dealing or usage of trade. We do not warrant that the Service or any plan will be accurate, complete, current, reliable, accessible, safe, suitable for your needs, uninterrupted, secure or error-free, or that any place, price, schedule, route or accessibility feature described will exist or be available.

15. Limitation of liability

To the maximum extent permitted by law, Merianda Estates, LLC and its members, managers, employees, contractors, agents, licensors and service providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or enjoyment, travel costs, missed or cancelled bookings, delays, personal injury, illness, property damage or other losses, arising out of or related to the Service, any plan, any third-party data, service or provider, or your travel, even if we were told such damages were possible.

To the maximum extent permitted by law, our total liability for all claims arising out of or related to these Terms or the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or US$50 if you paid nothing.

These limits apply to every theory of liability, including contract, tort (including negligence), strict liability and statute, and even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain exclusions or limits, so some of them may not apply to you; in that case our liability is limited to the fullest extent the law allows.

16. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify and hold harmless Merianda Estates, LLC and its members, managers, employees, contractors and agents from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service or any plan, your travel or that of your companions, the information you enter, your violation of these Terms, or your violation of any law or the rights of any third party.

17. Binding arbitration and class-action waiver

Informal resolution first. Before starting arbitration, you and we agree to try to resolve any dispute informally for at least 30 days after one side sends the other a written notice describing the claim. Send notices to us at Merianda Estates, LLC, 4900 Airport Pkwy Unit 989, Addison, TX 75001, USA.

Arbitration. Except as stated below, any dispute, claim or controversy arising out of or relating to these Terms or the Service, including their formation, scope or enforceability, will be resolved by final and binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration will take place in Dallas County, Texas, or by video or written submissions where the AAA rules allow. Payment of AAA fees is governed by the AAA rules. The Federal Arbitration Act governs this Section. Judgment on the award may be entered in any court with jurisdiction.

Class-action waiver. You and we each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may not consolidate claims or award relief to anyone other than the individual party. You and we waive any right to a jury trial.

Exceptions. Either party may bring an individual claim in small-claims court if it qualifies and stays there. Either party may also seek an injunction in court to stop infringement or misuse of intellectual property.

Opt-out. You may opt out of this arbitration agreement by mailing a signed written notice to the address above within 30 days after you first accept these Terms, stating your name and that you opt out of arbitration.

If the class-action waiver is found unenforceable for a claim, that claim (and only that claim) will proceed in court under Section 18, not in arbitration. This Section survives the end of your use of the Service.

18. Governing law and venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules, and by applicable U.S. federal law. Subject to Section 17, any claim that is not arbitrated must be brought exclusively in the state or federal courts located in Dallas County, Texas, and you and we consent to their personal jurisdiction.

19. Changes to these terms

We may update these Terms from time to time. We will post the new version here and change the "Last updated" date. When the changes are material, we may ask you to accept the new Terms in the planner before creating another plan. Continuing to use the Service after changes take effect means you accept them. Changes do not apply to a dispute that arose before the change was posted.

20. General terms

  • Entire agreement. These Terms, the Privacy Policy and the Disclaimer are the entire agreement between you and us about the Service and replace any earlier understandings.
  • Severability. If any provision is found unenforceable, it will be enforced to the maximum extent permitted and the rest of these Terms will remain in effect.
  • Survival. Sections on AI content, verification, your responsibility, third parties, payments, intellectual property, disclaimers, limitation of liability, indemnification, arbitration, governing law and these general terms survive any end of your use of the Service.
  • No waiver. Our failure to enforce a provision is not a waiver of it.
  • Assignment. You may not transfer these Terms. We may assign them, for example in a merger or sale of the business.
  • Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including failures of third-party services.
  • Electronic communications. You agree that agreements, notices and other communications we provide electronically satisfy any requirement that they be in writing.
